Are You Too Busy to Think About a Bankruptcy?

Debt has a funny effect on the lives of people who have to deal with it on a day to day basis (and who doesn’t in one way or another?)  We see mounting bills and they keep piling on in and then we see the little amount of cash coming into the coffer, we get stressed out, take on another job or two…  can’t take care of ourself, get sick, more bills, etc, etc…

When you get trapped into the deep debt cycle, there is very little that seems like can be done.  Considering bankruptcy would be interesting, but really, who has time for that?  And isn’t declaring bankruptcy (Chapter 7 or Chapter 13) kind of admitting defeat?

For people in this painful cycle, you should consider a no cost bankruptcy consultation.  Our attorneys work hard to keep your energy and time committment at a minimum, and realize there can be emmense value to a fresh start.  If you would like a fresh start on your finances, if you have hit the end of your tether, give us a call for a Fort Collins bankruptcy consultation!

Questions Abound With DIY Bankruptcy in Fort Collins

Questions Abound With DIY Bankruptcy in Fort Collins

There is a trend towards doing everything ourselves because it is tough to make it in the current economy.  A Do It Yourself bankruptcy (DIY) is one of the worst places to try and circumvent the need for skilled help.  First of all, here are a few things to consider:

  • Bankruptcy Attorneys in Fort Collins go to school for years to make sure we are practicing our trade according to the laws.  We have strong ambitions to comply with the laws (so we don’t lose our ability to practice law).  What does the site you are looking at have in the game?  They are selling paperwork, not bankruptcy help.  We offer some initial information, but expect you will want to take advantage of our free initial bankruptcy consultation to see where you will line up.
  • A Bankruptcy Attorney in Fort Collins can answer questions.  Especially if you are doing a Chapter 13 Bankruptcy, you will need questions answered!
  • A bankruptcy attorney has walked this road with others before.  How good were you at golf or cooking the first time you tried it?  Skills are developed over time and your financial security is not a great place to practice a new skill set.
  • If sucessful, most of your other obligations will go away.  We are here to help you get a fresh start.  The small cost of the bankruptcy attorney in Fort Collins will seem scant when compared to your current obligations.

Bankruptcy Fraud is a Crime

Bankruptcy Fraud is a Crime

Bankruptcy fraud in Colorado is a federal crime.  If you are considering filing bankruptcy in Fort Collins, we doubt that you have the $250,000 you could be fined for trying to hide that $2,500 or the fact you work a small part time job which you don’t want to declare income from because you do some of the work for cash.  How could they find out?  Is there really a risk?

Well, to insure that people are declaring everything, the Executive Office of the United States Trustee has put together a handy little website to allow your ex, your neighbors or your co-workers to  report they suspect you are hiding income.  Yeah, you think, but this is only $2,500.00.  Who would really worry about whether I didn’t declare a measly $2,500 in my bankruptcy case in Colorado?  Isn’t that the point?  It is only $2,500.  It is not worth it.

Really the moral of the story is to make sure that you disclose everything to your bankruptcy attorney in Fort Collins and we will do everything to help get your financial feet back under you.

How to Drive Your Bankruptcy Attorney Crazy!

How to Drive Your Bankruptcy Attorney Crazy!

Today is one of those days I have to vent.  I know, you’re thinking that this is not a good format for venting, after all, I am supposed to be dealing with bankruptcy issues in Fort Collins…  But there are those days that being a bankruptcy attorney in Fort Collins is not as sexy as it might sound.  Bear with me today as I go over some of my current frustrations, and hopefully you will at least learn how not to frustrate your bankruptcy attorney in Fort Collins to the brink of driving his car into oncoming traffic.
Few people realize it, but the main reason why attorneys do not give out their personal cell phones is due to a very small portion of clients who ruin the system for everyone.  Many of my Chapter 7 bankruptcy clients and Chapter 13 bankruptcy clients are fine individuals who are generous and respectful people, who only call when there is an actual question or issue at stake.

Then there are the 3 percent-ers.

You know who you are.  You are the person who stares at the clock at 10 pm on a Sunday, and with burning question in mind picks up the  phone to call your attorney’s emergency contact “do not call unless you are on fire or in jail and on fire” number.

A = Attorney
C = Client

C Mr. Attorney?

A Yes?

C I know that its late…is this a good time?

A Well, I’m actually just finished putting the 2 year old to bed and the wife just collapsed so I…

C <cutting off>  Good good, this will just take a second.  You know that issue that you went over with me 40 times last week and I didn’t like the answer?  You know, about keeping my three porsches and the 40K in cash under the bed?  I wanted to know, have you done any more research on this…I read an article that Obama had changed things.

A <stoney silence>

A No, nothing has changed.  We went over this on Friday.

C Really?  I don’t remember this, are you sure?  I thought you told me when I hired you that this was a sure thing?

<sound of phone being thrown against the wall>

C Hello?  Hello?

Now, to all the people that are reading this and thinking “Well, what a terrible thing to do to the bankruptcy attorney who I hired and keeps me safe and protects my financial future” feel free to call.  For the people that think “Well, I paid him a $500.00 retainer, he should be my genie at my beck and call or I will call the attorney I found scrawled on the back on an abandoned Westword” please do our profession a favor and throw yourself in front of the nearest bus.

Then there are the scammers.  Here is the bottom line.  You will get caught.  You will be caught, you will be exposed, and the lies you tell and everyone you throw under the bus (including your attorney) to ensure that you get your way will eventually trip you up and land you flat on your ass.

Lying to the court is bad enough…lying to the attorney who is representing you to this court is just stupid.  Mind blowing, epic, stupidity.

I have actually had potential client in Fort Collins bounce a check off of our office.  A bankruptcy client, who writes a check…and BOUNCES it.  Intentionally.  Just so we would take him as a client.  Sigh.

Bankruptcy, yes it’s a scary time to have to venture into.  No one volunteers to deal with bankruptcy.  There are all of the standard concerns like “I am an honest person, should I actually file for bankruptcy?” This is a legitimate question which we would encourage you to pursue.  Bankruptcy is a serious decision, but sometimes there is no other real decision to be made.   When bills are so far out of hand and income is so low, there’s not a lot to do.

3. Divorce — Divorce can wreak havoc on personal finances.
4. Out of Control Credit Cards — It can be impossible to make up ground if your credit cards have gone out of control.
