Finances may not always be a cup of coffee, but bankruptcy is not always the answer in Fort Collins!

Yes, we are a bankruptcy firm in Fort Collins.  What does this mean exactly?  Basically, our job is to help our clients protect their financial well being through the bankruptcy code or other avenues the law provides.  This can include bankruptcy filing, but then again, it is our obligation to let you know when you are going to have trouble getting your debts erased through bankruptcy.  This is what the initial consultation is all about.  When do we see people where it seems they are going to struggle getting their debts discharged.

  1. Source of financial strain is child support payments.  This kind of debt can’t be discharged.
  2. Source of strain is student loans
  3. You make enough to pay your bills
  4. You didn’t pay taxes and now penalties are high and makes it hard to pay bills.  Tax debt also cannot be discharged.

If you want to see if you qualify for assistance under the bankruptcy code, please give us a call for a free initial bankruptcy consultation in Fort Collins!

Don't Fall for the Bankruptcy Traps Out There...

Don't Fall for the Bankruptcy Traps Out There...

There are a lot of traps in regards to bankruptcy attorneys in Fort Collins these days.  Some firms advertise fees as low as $499 for a bankruptcy filing, but this is nothing more than you come in and they hand you a stack of papers, and that is your filing.  Before you file, you should consider these three factors in your assessment of bankruptcy attorneys in Fort Collins.

Work with a Partner, not an internet program.  If you choose an internet program instead of a live attorney, you are on your own and they are not reveiwing you case to make sure you have a shot to win the judgement from the courts…  a nice deal for them, print off 300 pages or so, have one appointment and send you away.  If you lose, it’s no big deal to them.  This is why you need to be careful!

Bankruptcy Filing is Complicated:  Bankruptcy filing takes time and accuracy.  If you are going to get your fresh start, you need to do things the right way.  The way we look at bankruptcy filing is that we don’t take on clients that have little to no chance of winning.  These guys will, and then you’ll just be down $500 more dollars.

We understand your financial dilemna:  We know you are desperate for a solution.  We offer a free consultation and if you are a bad canidate, we tell you and don’t take you on as a client.  The only real way you’ll pay us money is by using our services.

Gentler Times For Michael Vick?

Gentler Times For Michael Vick?

I want to write this blog to both complain and compliment the American Legal System.  Michael Vick, the notorious man who was indicted in a dogfighting ring recently filed for bankruptcy.  How can this be, most of us who make less tha the 1.5 million Vick is going to get paid this year find this kind of crazy.  Now, bankruptcy is designed to help a person in dire financial straights, and believe it or not, but Mr Vick has a lot of debts and not much income.  As of the last accounting we saw, he owed just over $20,000,000 and has assets of just over $16,000,000.  That’s a $4 million dollar differential.

Now, how does an athlete who seems to be forgiven everything because he is electric on the playfield, is able to kill dogs and skate away after filing bankruptcy.  Now, we must remember, the law does not (or should not) decide to make one suffer because they don’t have a personality or a morality we agree with.  What does that mean for you and I?  Basically, it is an awesome thing for someone really struggling to even keep up with their interest payments.  The law allows us all a fresh start.

Michael Vick is involved in a Chapter 13 filing, so it is important to realize he still is responsible for his debts.  A chapter 13 bankruptcy fining in Fort Collins is just the same.  You may not be making over a million dollars.  Bankruptcy is blind to the normal classes that divide us…  Male/Female, Black/White, Rich/Poor…  A white woman has the same chance to be given bankruptcy protection if she has $30,000 of credit card debt as a rich African American does if his legal expenses and debts have become too burdensome.  Yes, we all find dogfighting to be sick…  but the good news is we live in a country where our courts are rightfully supposed to care more about facts than it does about race or sex or age or religion.  If you need any help looking at your situation in Fort Collins, give us a call.

Bankruptcy, if done correctly and with quality legal council, can give you a new financial beginning.   Generally people don’t consider bankruptcy unless life has dealt them a hand they can’t play.   There are the scammers of course, who GET CAUGHT by the way, but generally the average client walking in the door has had something catastrophic happen or they’re dealing with some foolish decisions from earlier in life.

If you’re considering filing for bankruptcy in Fort Collins due to medical bills, divorce, or business failure, make sure you’re not starting over when you have less dramatic options available.   Creditors can be understanding, especially when they find out you’re looking at bankruptcy in Fort Collins as a possibility. I recommend meeting with an experienced bankruptcy attorney, an accountant, and your spouse (if you’re married).   If you don’t have to start from scratch with your credit, you’ll end up being ahead in the long run.   If however, bankruptcy is the only way for you to regain your financial freedom, it could be your ticket to a new beginning.
