Why is a Bankruptcy Attorney Essential for a Filing?

Don't Get Overwhelmed with Changing Laws!

As the economy continues to stagger here in the United States, and especially in northern Colorado, more people are needing the fresh start a bankruptcy filing can provide.  Some people are tempted to try and file the paperwork and go through the procedure on their own.  This is an issue for those who try and do this.  We have all heard about being penny wise and pound foolish…  meaning that sometimes the most crucial thing you can do is to know how to wisely guard your assests more than simply never spending.  Watching pennies as dollars slip through your fingers.

Bankruptcy attorneys in Fort Collins have to keep up on Colorado laws, which can change at any time and affect your filing.  Laws change.  This is why you want an attorney protecting your interests.  One individual we know of had a condo and they listed the condo as one of their assets in their declaration of assets.  The thing they forgot to do was to also list their $20,000 parking space.  They kept their condo, yes they did much of it right.  They lost the parking…  In order to save about $750 (the difference between the cost of their filing and what our fees would have been), they lost a $20,000 asset.

The Vicious Debt Cycle

The Cruel Debt Cycle!

If you have lived long on this planet, you understand a few basic rules that seem to always be in play.  The rich get richer, the poor get poorer, those who owe end up owing more.  Why is this?  Why is it that good, hard working people always seem to be getting the short end of the financial stick?  Why is it the harder they work, the deeper they sink?  Basically it comes down to this principle…  Those with the gold, rule.

If you are in a position of constant debt that is impossible to get away from, and the more you owe, the higher the interest rate you are forced to pay, to the point where you are not even making payments on time because you can’t…  you may want to consider a bankruptcy filing in Fort Collins!

One great thing about my job is I get to help people who are struggling, good hard working people, find relief from years of stress they have been fighting.  I get to see the relief in their eyes when they get the fresh start they need.  Most people who file bankruptcy are not irresponsible people who ran up credit cards on trips to Vegas…  they are our neighbors who got a terrible life break.  Bad health, a layoff or other extreme calamity.  Our job is to help make life more bearable for those who are in this position.

Finances may not always be a cup of coffee, but bankruptcy is not always the answer in Fort Collins!

Yes, we are a bankruptcy firm in Fort Collins.  What does this mean exactly?  Basically, our job is to help our clients protect their financial well being through the bankruptcy code or other avenues the law provides.  This can include bankruptcy filing, but then again, it is our obligation to let you know when you are going to have trouble getting your debts erased through bankruptcy.  This is what the initial consultation is all about.  When do we see people where it seems they are going to struggle getting their debts discharged.

  1. Source of financial strain is child support payments.  This kind of debt can’t be discharged.
  2. Source of strain is student loans
  3. You make enough to pay your bills
  4. You didn’t pay taxes and now penalties are high and makes it hard to pay bills.  Tax debt also cannot be discharged.

Are You Too Busy to Think About a Bankruptcy?

Debt has a funny effect on the lives of people who have to deal with it on a day to day basis (and who doesn’t in one way or another?)  We see mounting bills and they keep piling on in and then we see the little amount of cash coming into the coffer, we get stressed out, take on another job or two…  can’t take care of ourself, get sick, more bills, etc, etc…

When you get trapped into the deep debt cycle, there is very little that seems like can be done.  Considering bankruptcy would be interesting, but really, who has time for that?  And isn’t declaring bankruptcy (Chapter 7 or Chapter 13) kind of admitting defeat?

For people in this painful cycle, you should consider a no cost bankruptcy consultation.  Our attorneys work hard to keep your energy and time committment at a minimum, and realize there can be emmense value to a fresh start.  If you would like a fresh start on your finances, if you have hit the end of your tether, give us a call for a Fort Collins bankruptcy consultation!

Your Checklist of How to Make Life Miserable!

This article is for all those people that enjoy suffering.  If you re one of the people who think suffering is fun and that stress is good for the soul, here is an article for you.  Follow these simple steps in your financial life and you will be stressed out and more miserable than you could imagine.

  • Overspend — This is a key to adding stress.  Don’t actually write out a budget and definately don’t stick to it!
  • Accrue more debt — If you can get more credit cards, buy a car, get another house, have some botox done…  whatever it takes!
  • Make sure you are always late on your payments so that you can pay the extra fees associated with the late charges.  DO not, under any circumstance call the creditor to tell them your situation and work something out…  that will not add stress to your life like you may want, it’d actually reduce it a bit.
  • Get behind on your house payments.  This is great for increasing stress knowing you may be on the street at any time.
  • When it finally does hit the fan, do a bankruptcy filing yourself.  It is an amazing way to increase the stress in your life.  If you are going to file a chapter 13 bankruptcy in Fort Collins, you LOVE this.  It is one of the most stressful filings out there and you definitely won’t want an experienced bankruptcy attorney to help you in your case!

If you want something a bit more pleasant and if you don’t like to suffer, if your bills are already out of control and you are more stressed out than you want to be…  giving us a call should be the action item for you.  We work hard as Fort Collins Bankruptcy Attorneys to make your life more peaceful and your financial woes to go away!

Do You Have the Weight of the World on Your Shoulders?

Each Mounting Bill Seems to Add Weight to Your Shoulders!

Each Mounting Bill Seems to Add Weight to Your Shoulders!

You go to the mailbox, concerned that this day there will be more bills and more bad news.  You feel the weight of each envelope in your hand, you see “past due” on several of the envelopes.  You would like to be caught up in your bills, but with the circumstances life has dealt to you this past year; health issues, getting laid off, that divorce, and a few bad decisions (you will be honest here too)…  The bills have become unmanageable.  You have lost hope. Is there anything you can do?

We feel your pain.  We got into bankruptcy law because we believe in the process the US Government allows in giving citizens a fresh start when things become so out of hand they can not meet their financial obligations.  We know most people do not seek bankruptcy protection because they will figure out a way to get their bills paid.  There are some though that have such a heavy weight they can not lift it themselves!  They need help getting some of the weight off of their shoulders.  Businesses have the same opportunity with Chapter 11 bankruptcy in Fort Collins.  Individuals, however will file for Chapter 7 bankruptcy or Chapter 13 bankruptcy.  One gives a “payment plan” while the other gives a “fresh start”…  It can be complicated learning which, if either you can qualify for.

We understand you already feel enough pressure, you don’t need to add bankruptcy research to your already heavy workload.  With a quick 1 hour free consultation, we can tell you whether or not you have a good chance to successfully file for Chapter 7 bankruptcy protection or Chapter 13 bankruptcy protection…  or neither.  Our job is to protect your financial future.  We know the system, we know the laws and we can do in a few hours what it would take you 40 hours to do.  Can you do a “Do It Yourself Bankruptcy Filing“?  Of course, but, it is likely you will miss important details and the creditors will certainly have attorneys on their side to try and make sure you don’t get relief.  Our job is to ensure that your weight is lessened and that your financial future is as secure as possible.

The Day Santa Went Bankrupt… A Sad Tale…

Santa After Learning He Had Gone Bankrupt...

Santa After Learning He Had Gone Bankrupt...

Santa had a rough year with the economy the way it was last year.  He found that the price of feed for the reindeers had gone up and his credit cards were through the roof.  The elves were demanding a pay increase and the credit card companies had raised his rates.  Mrs Claus falling and breaking her hip as she was baking delicious Christmas cookies certainly did not help…  And we all heard about Rudolph’s trip to the hospital when he contracted the H1N1 virus.  Yes, Santa had a tough year and needed some help filing for bankruptcy.  He went through his list and found there were only 3 attorneys in the country who were not on the naughty list and luckily one of them was a bankruptcy attorney.  You can imagine our shock the day Santa called!

As we met with Santa, we had some basics to work out.  First of all, would he qualify for a Chapter 7 bankruptcy or would we need to file a Chapter 13 bankruptcy on his behalf?  Unfortunately, Santa brings in a lot of cash to the North Pole…  So he failed the means test.  This meant we would have to file a Chapter 13 Bankruptcy for Santa.  Santa would have to pay back all the people he owed money to.

Luckily, we were able to get a discharge on some of his debts, but he does have a repayment plan that extends over the next 5 years.  We hate to be the bearers of bad news, but Santa may be a little cheaper this year than he had been in the past for you.  Don’t expect that sweet toy because Santa is not allowed to overspend for the next 5 years by order of the court.  The good news is Santa will still be allowed to keep his place at the North Pole.  It would be a bit weird to have Santa living in Fort Collins

If you would like to meet with us knowing if we could save Christmas for Santa, your case certainly will not be too challenging to us, please give us a call for a free initial  bankruptcy consultation to see what we can do for you.  Please bake Santa some extra good cookies this year and he’ll still be able to enjoy the holidays because of these goodies and knowing his creditors can’t bother him so he can focus on being the merry man we have all grown to love.

Questions Abound With DIY Bankruptcy in Fort Collins

Questions Abound With DIY Bankruptcy in Fort Collins

There is a trend towards doing everything ourselves because it is tough to make it in the current economy.  A Do It Yourself bankruptcy (DIY) is one of the worst places to try and circumvent the need for skilled help.  First of all, here are a few things to consider:

  • Bankruptcy Attorneys in Fort Collins go to school for years to make sure we are practicing our trade according to the laws.  We have strong ambitions to comply with the laws (so we don’t lose our ability to practice law).  What does the site you are looking at have in the game?  They are selling paperwork, not bankruptcy help.  We offer some initial information, but expect you will want to take advantage of our free initial bankruptcy consultation to see where you will line up.
  • A Bankruptcy Attorney in Fort Collins can answer questions.  Especially if you are doing a Chapter 13 Bankruptcy, you will need questions answered!
  • A bankruptcy attorney has walked this road with others before.  How good were you at golf or cooking the first time you tried it?  Skills are developed over time and your financial security is not a great place to practice a new skill set.
  • If sucessful, most of your other obligations will go away.  We are here to help you get a fresh start.  The small cost of the bankruptcy attorney in Fort Collins will seem scant when compared to your current obligations.
